SCOPE OF SERVICE
Modma Studios provides game art and production services across mobile, PC, and console platforms. Our services may include, but are not limited to, character art, environment art, animation, and production support.
All services are defined and agreed upon through separate project agreements, statements of work, or contracts.
ENGAGEMENT AND AGREEMENTS
Each engagement with Modma Studios is governed by a written agreement that outlines:
• Scope of work
• Deliverables and timelines
• Pricing and payment terms
• Team structure and collaboration model
In case of any conflict, the project-specific agreement takes precedence over these Terms.
CLIENT RESPONSIBILITIES
To ensure smooth delivery, clients are expected to:
• Provide clear briefs, references, and requirements
• Share timely feedback and approvals
• Assign a point of contact for coordination
• Ensure all provided materials are legally owned or licensed
Delays in communication or approvals may impact delivery timelines.
DELIVERY AND TIMELINES
We operate with structured pipelines and production schedules to ensure consistent delivery.
Timelines are:
• Estimated based on agreed scope
• Dependent on timely feedback and approvals
• Subject to revision if scope changes
We communicate proactively in case of risks or delays.
PAYMENTS AND INVOICING
Payment terms are defined in the project agreement and may include:
• Milestone-based payments
• Monthly billing for ongoing engagements
Invoices are payable within the agreed timeframe. Delayed payments may impact project continuity.
INTELLECTUAL PROPERTY
Ownership of deliverables is defined in the project agreement.
Unless otherwise stated:
• Final, paid deliverables are transferred to the client
• Modma Studios retains the right to showcase work in portfolios, case studies, and marketing materials, unless restricted by NDA
Any third-party assets remain subject to their respective licenses.
CONFIDIENTALITY
We treat all client information as confidential.
Both parties agree to:
• Protect sensitive project and business information
• Not disclose confidential materials to third parties without consent
Additional confidentiality terms may be defined under a Non-Disclosure Agreement (NDA).
REVISIONS AND SCOPE CHANGES
Revisions are handled as part of the agreed workflow.
• Feedback cycles are defined during project planning
• Requests beyond the agreed scope may be treated as additional work
• Any scope changes are documented and approved before execution
LIMITATION OF LIABILITY
Modma Studios is not liable for:
• Indirect or consequential losses
• Delays caused by external dependencies or client-side issues
• Use of deliverables beyond intended scope
Our total liability is limited to the value of the services provided under the specific agreement.
TERMINATION
Either party may terminate the engagement based on terms defined in the project agreement.
Upon termination:
• Work completed up to that point is invoiced
• Deliverables are shared based on payment status
• Access to ongoing resources may be withdrawn
USE OF WEBSITE
By using our website, you agree not to:
• Misuse content or attempt unauthorized access
• Copy or distribute materials without permission
• Engage in activities that disrupt site functionality
All website content remains the property of Modma Studios unless stated otherwise.
GOVERNING LAW
These Terms are governed by applicable laws of the jurisdiction defined in the project agreement or company registration.
UPDATES TO TERMS
We may update these Terms periodically to reflect changes in services or legal requirements.
